Uncontested Divorce
In British Columbia , there are three grounds for obtaining a divorce. The first is separation for one year, often known as the no-fault divorce. The second ground is adultery and the third is physical or mental cruelty. In order to obtain a divorce, three things must be proven: a) that the marriage exists, as evidenced by the filing of a marriage certificate; b) the grounds for divorce; and c) that there are reasonable arrangements in place for the support of any children of the marriage, if applicable.
In addition to divorce, there may be several corollary issues that have to be dealt with, including custody issues, child and/or spousal support and division of assets.
